These Terms of Service (“Terms”) govern your access to and use of Bandslide(the “Service”), operated by Bandslide (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.

1. Who we are

2. Eligibility and account registration

  • You must be at least 13 years old (or the age of digital consent in your location) to use the Service.
  • You are responsible for the accuracy of information you provide and for maintaining the confidentiality of your account credentials.
  • You agree not to share your account or allow others to access it, except as permitted by features we provide.

3. Your content and data

You may upload, submit, or store content in the Service (“Customer Content”), such as profile information, text, images, set lists, gig details, links, and other data. You retain ownership of your Customer Content.

You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and display Customer Content only as necessary to operate, secure, and improve the Service and to provide features you choose (for example, publishing a public profile).

You represent that you have all rights needed to provide Customer Content and that it does not infringe or violate the rights of others.

4. Acceptable use

You agree not to misuse the Service. For example, you will not:

  • Violate any law or regulation.
  • Post or transmit content that is unlawful, harmful, harassing, defamatory, or invasive of privacy.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Reverse engineer, decompile, or attempt to extract source code, except to the extent permitted by law.
  • Interfere with or disrupt the Service, including by introducing malware or abusing rate limits.
  • Use the Service to send unsolicited messages or spam.

5. Public features

Some features may allow you to make content public (e.g., a public profile, public gig calendar, or landing page). You control what you publish. If you make content public, you understand it may be viewed, indexed, and shared by others.

6. Subscriptions, trials, fees, and taxes (if applicable)

If the Service offers paid plans, you agree to pay fees and applicable taxes as described at checkout or in the plan description. We may change prices with notice as required by law. Unless otherwise stated, fees are non-refundable.

7. Third-party services

The Service may integrate with third-party services (e.g., social media links, embedded players, analytics). Your use of third-party services is governed by their terms and policies. We are not responsible for third-party services.

Our infrastructure may use providers such as Vercel (hosting) and Supabase (authentication, database, storage). See the Privacy Policy for details on processing.

8. Intellectual property

We and our licensors own the Service, including software, design, and branding, and all related intellectual property rights. These Terms do not grant you any rights to our trademarks or branding.

9. Feedback

If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.

10. Suspension and termination

We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, pose a security risk, or as required by law. You may stop using the Service at any time.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Bandslide WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS.

13. Indemnification

You agree to indemnify and hold harmless Bandslide from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Customer Content or your misuse of the Service.

14. Governing law and dispute resolution

These Terms are governed by the laws of United States, without regard to conflict of law principles. Any disputes will be brought in the courts located in Boston, MA, USA, unless required otherwise by law.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., by posting in the Service). Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
